Welcome to Parts2U. These Terms of Service (“Terms”) govern your use of the Parts2U mobile application (the “App”) and any purchases made through it.
By creating an account or using the App, you agree to these Terms. If you do not agree, do not use Parts2U.
1. Eligibility and Acceptance
You must be at least 18 years old to use Parts2U.
By accessing or using the App, you represent that:
You are at least 18 years old
You have the legal capacity to enter into a binding agreement
All information you provide is accurate and complete
2. Account Registration
To place orders, you must create an account.
You agree to:
Provide accurate and current information
Maintain the security of your login credentials
Notify us immediately of any unauthorized use of your account
You are responsible for all activity that occurs under your account.
3. Orders and Custom Fabrication
Parts2U products are custom-fabricated according to the specifications you provide, including but not limited to stone type, dimensions, and edge profiles.
You are responsible for ensuring all measurements and specifications are accurate before placing your order.
All orders are subject to:
Product availability
Confirmation of payment
Our acceptance of the order
We reserve the right to refuse or cancel any order at our discretion.
4. Pricing and Payment
All prices are displayed in U.S. dollars.
Payment is processed securely through Stripe at the time of checkout. By submitting payment information, you authorize us and our payment processor to charge the full order amount, including applicable taxes and fees.
Once payment is successfully processed, you will receive an order confirmation.
5. Shipping and Delivery
Shipping timelines provided in the App are estimates and are not guaranteed.
You are responsible for providing an accurate shipping address. We are not responsible for delays or losses resulting from incorrect or incomplete shipping information.
Risk of loss transfers to you upon delivery of the product to the shipping carrier or delivery location, as applicable.
6. Refunds and Cancellations
Because products are custom-fabricated to your specifications, all sales are final.
We do not offer refunds or cancellations once fabrication has begun.
If your order:
Arrives damaged, or
Does not match the specifications you submitted
You must contact support@parts2u.com within 7 days of delivery.
We may require photographs or documentation to evaluate the claim. If approved, we may, at our discretion:
Replace the product, or
Issue a partial or full refund
7. Intellectual Property
All content within the App, including but not limited to:
Text
Graphics
Logos
Designs
Software code
Product configurators
is the property of Parts2U and is protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission.
8. Prohibited Use
You agree not to:
Use the App for unlawful purposes
Attempt to interfere with the App’s functionality or security
Reverse engineer or attempt to extract source code
Use automated systems to access the App without authorization
9. Disclaimer of Warranties
The App and all products are provided “as is” and “as available.”
To the fullest extent permitted by law, Parts2U disclaims all warranties, express or implied, including:
Merchantability
Fitness for a particular purpose
Non-infringement
We do not guarantee that the App will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, Parts2U shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or purchase of products.
Our total liability for any claim related to a specific order shall not exceed the amount you paid for that order.
11. Indemnification
You agree to indemnify and hold harmless Parts2U from any claims, damages, losses, or expenses arising from:
Your misuse of the App
Your violation of these Terms
Your inaccurate product specifications
12. Termination
We may suspend or terminate your account at any time if:
You violate these Terms
We suspect fraudulent activity
We discontinue the App
Termination does not relieve you of any payment obligations incurred prior to termination.
13. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will notify you through the App or by email.
Continued use of the App after updates constitutes acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States and the state in which Parts2U operates, without regard to conflict of law principles.
Any disputes arising under these Terms shall be resolved in the state or federal courts located in that state, and you consent to the jurisdiction of those courts.
